Terms of Service

1. Acceptance of Terms

By creating an account or using ClimbMetrics ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

ClimbMetrics provides keyword rank tracking, on-page site audits, AI-generated SEO recommendations, and related reporting features for websites you own or are authorised to analyse.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and notify us of any unauthorised use.

4. Acceptable Use

You agree not to: (a) scrape, audit, or track websites you do not own or have permission to analyse; (b) reverse engineer the Service; (c) resell access without a written agreement; (d) submit unlawful, infringing, or harmful content.

5. Subscriptions & Billing

Paid plans are billed in advance on a recurring basis through Stripe. Subscriptions automatically renew until cancelled. You can cancel at any time from the Billing page; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

6. Third-Party Services

The Service relies on third-party providers (Stripe for payments, Supabase / Lovable Cloud for hosting and storage, Firecrawl for site crawling, AI providers for recommendations). Your use of the Service is also subject to those providers' terms.

7. Intellectual Property

The Service, including all software, design, and content (excluding your data), is owned by ClimbMetrics or its licensors and protected by intellectual property laws.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. Search engine rankings and AI recommendations are estimates and not guarantees of business outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, ClimbMetrics' total liability for any claim arising out of the Service is limited to the amount you paid in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your account for breach of these Terms. You may close your account at any time from Settings; closure deletes your data subject to our backup retention period.

11. Changes

We may update these Terms from time to time. Material changes will be notified by email or in-app. Continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
